STAYCLOTHED PRIVACY POLICY

This Privacy Policy explains how StayClothed collects, uses, shares and protects personal information when you visit stayclothed.com, place an order, contact us or otherwise interact with our store.

StayClothed is responsible for the personal information for which we determine how and why it is used.

Some organisations that help operate the store may act as data processors on our behalf, while others may act as independent data controllers for particular activities under their own privacy policies.

1. INFORMATION WE COLLECT

Depending on how you interact with StayClothed, we may collect information including your name, email address, telephone number, billing and delivery address, order and product information, account information, transaction and payment status, communications with us, return or refund information, photographs you provide in connection with a product problem, marketing preferences and customer-service history.

When you use our website, information such as your IP address, browser and device information, cookie identifiers, pages viewed, interactions with the store and approximate location information may also be collected automatically by Shopify or other technologies used by the store.

Payment card information is processed through our payment providers. StayClothed does not normally receive or store your complete payment-card details.

2. HOW WE RECEIVE YOUR INFORMATION

We receive information directly from you when you place an order, create or use an account, contact us, request a return or refund, subscribe to marketing or otherwise provide information to us.

We may also receive information automatically through the website and from organisations involved in operating or fulfilling your order, including Shopify, payment providers, fulfilment partners, Collective suppliers and delivery companies.

3. HOW AND WHY WE USE PERSONAL INFORMATION

We use personal information where necessary to operate StayClothed and provide our services.

Where processing is necessary to perform a contract with you, we use information to process and manage orders, take payment, arrange production and fulfilment, provide delivery information, communicate about an order, provide customer support and administer returns, replacements and refunds.

Where processing is necessary to comply with a legal obligation, we may use and retain information for accounting, taxation, consumer-protection, fraud-prevention, regulatory or other legal requirements.

We may rely on our legitimate interests where appropriate to operate, protect and improve StayClothed, prevent fraud or misuse, secure our systems, understand how the store is used, improve customer service, manage disputes and protect our legal rights. Where we rely on legitimate interests, we consider those interests against your rights and interests.

Where consent is required, we may rely on your consent for activities such as certain forms of marketing or the use of non-essential cookies and similar technologies. You may withdraw consent at any time.

4. SHOPIFY

Our online store is hosted and operated using Shopify.

Shopify processes information required to provide services including the storefront, checkout, payments and payment integrations, customer accounts, order management, security and other ecommerce functionality.

Shopify may also process device, usage and customer-interaction information for its own services in accordance with its privacy notices and applicable agreements.

Some Shopify features use Shopify Network Intelligence and related enhanced services. Where these features are enabled, Shopify may use customer and interaction data to provide services such as fraud and security protection, personalisation, analytics and other platform features, subject to applicable privacy controls and Shopify's privacy practices.

5. STAYCLOTHED ORIGINALS

StayClothed Originals are produced and dispatched for us by fulfilment partners.

When necessary to produce and deliver an Original, relevant order information is shared with the fulfilment partner handling that order. This can include information such as your name, delivery address, contact information and the products ordered.

Fulfilment partners may operate facilities or use service providers in different countries.

6. THE COLLECTIVE

Products in The Collective are supplied and fulfilled by independent suppliers through Shopify Collective.

When you order a Collective product, information necessary to process and fulfil the relevant part of the order is made available through Shopify to the supplier responsible for that product.

The supplier may use this information to fulfil and deliver the order, provide tracking, administer a return or resolve an order issue.

Collective suppliers may have their own privacy obligations and may process information as an independent controller where applicable.

7. OTHER ORGANISATIONS WE SHARE INFORMATION WITH

We may share personal information where reasonably necessary with payment processors, delivery companies, fulfilment partners, Collective suppliers, ecommerce and technology providers, website-security providers, analytics or marketing providers, professional advisers such as accountants or legal advisers, and public authorities where disclosure is required by law.

We do not disclose personal information to third parties simply because they request it. Information is shared where there is an appropriate business, contractual or legal reason.

8. COOKIES AND SIMILAR TECHNOLOGIES

StayClothed and the services used to operate the store may use cookies and similar technologies.

Some cookies are necessary for functions such as the shopping basket, checkout, security, remembering preferences and operating the website.

Other technologies may be used for analytics, personalisation or marketing.

9. MARKETING

You can unsubscribe from marketing emails using the unsubscribe option provided in the message or by contacting us.

Withdrawing from marketing does not prevent us from sending essential service communications relating to an order, return, refund or account.

StayClothed uses Shopify, fulfilment partners, suppliers and other service providers that may process personal information outside the United Kingdom.

Where StayClothed makes a restricted international transfer of personal information, we use a lawful transfer mechanism as required by applicable UK data-protection law.

Depending on the recipient and destination, this may include UK adequacy regulations or appropriate safeguards such as approved contractual protections.

Service providers may also make international transfers under the safeguards and mechanisms described in their own applicable privacy terms.

11. HOW LONG WE KEEP INFORMATION

We keep personal information only for as long as it is reasonably necessary for the purpose for which it was collected and to meet our legal, accounting, tax, contractual and dispute-resolution obligations.

The appropriate retention period depends on the type of information and why it is being processed.

For example, order and transaction records may need to be retained after an order has been completed to meet accounting, taxation, consumer-rights or legal-claims requirements.

Information used only for marketing will not be retained for that purpose where you have withdrawn the relevant consent or otherwise validly opted out, subject to any limited records we need to retain to respect your preference.

We take reasonable organisational and technical measures to protect the personal information under our control.

We also use established ecommerce, payment and fulfilment providers that maintain their own security measures.

However, no internet transmission, electronic storage system or online service can be guaranteed to be completely secure.

Depending on the circumstances and applicable law, you may have rights to ask for access to your personal information, correction of inaccurate information, deletion of information, restriction of processing, transfer of certain information to you or another provider, and information about how your data is used.

Where processing is based on consent, you may withdraw that consent at any time. Withdrawal does not make earlier lawful processing invalid.

StayClothed does not intend to make decisions about you that produce legal or similarly significant effects solely by automated means unless such processing is permitted by law and the required safeguards and information are provided.
